THE DOWN PAYMENT When you sign the purchase contract for your new home, you will be asked to deposit with the sellers attorney (to be held in his escrow account) an amount of money sufficient to show that you are a genuine purchaser and interested in completing the transaction. Generally, this amount represents ten (10%) percent of the purchase price. Recently, most attorneys for the seller have been willing to hold an amount equal to five (5%) percent of the purchase price or an alternative negotiated amount. Your deposit assures the seller that you will proceed diligently to obtain mortgage financing (if necessary) and perform your other contractual obligations including attending the closing and completing the purchase.
